Welcome to Afrikapp. By using our platform, you agree to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern Afrikapp's relationship with you in relation to this website. If you disagree with any part of these terms and conditions, please do not use our website. By registering on the Website, you confirm that you have fully read, understood, and agreed to be legally bound by these terms and conditions, which form the entire agreement between this Website and you. The term 'Afrikapp' or 'us' or 'we' refers to the owner of the website. The term 'you' refers to the user or viewer of our website. The use of this website is subject to the following terms of use:

Definitions
  • "Client" refers to any user who posts jobs on Afrikapp.
  • "Freelancer" or "Talent" refers to any user who applies for and works on jobs posted on Afrikapp.
  • "User" refers to anyone using the Afrikapp platform, including both clients and freelancers.
  • "Platform" refers to the Afrikapp website and any related services provided by Afrikapp.
Account Registration

To use Afrikapp, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify Afrikapp immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage that you may incur as a result of someone else using your account, either with or without your knowledge. However, you could be held liable for losses incurred by Afrikapp or another party due to someone else using your account. You may not use anyone else's account at any time without the permission of the account holder. Afrikapp reserves the right to refuse service, close accounts of any users, and change eligibility requirements at any time. Afrikapp may also terminate accounts that are inactive for an extended period of time.

Membership Plans

Afrikapp offers different membership plans for clients and freelancers, each providing various benefits and features. Details of these plans can be found on our website. The membership plans are one-time purchases and are non-refundable. When you upgrade your plan, you agree to the associated fees and terms. Membership plans are subject to change at any time, and Afrikapp reserves the right to modify or discontinue any plan without notice.

Posting Jobs

Clients can post jobs on Afrikapp by providing detailed descriptions, requirements, and deadlines. Afrikapp reserves the right to review, approve, or reject any job post. Clients on a free plan will have their job posts reviewed within 24 to 48 hours, while those on a membership plan will have their posts approved instantly. Job posts that violate our terms of service will be rejected. Afrikapp is not responsible for the quality of work delivered by freelancers. Clients are encouraged to review freelancers' profiles, portfolios, and ratings before hiring them. Clients can also request samples of work when chatting with a freelancer to ensure they meet their requirements.

Applying for Jobs

Freelancers can apply for jobs by submitting proposals that outline their skills, experience, and proposed terms. Clients can review these proposals, communicate with freelancers, and hire the best candidate for their project. Afrikapp shall not be held liable for any disputes that may arise between clients and freelancers. Freelancers are responsible for delivering high-quality work that meets the client's requirements. Clients are responsible for providing clear instructions and timely feedback to freelancers. Freelancers are responsible for checking their email and Afrikapp dashboard regularly for job notifications and updates. Afrikapp is not responsible for missed job opportunities due to failure to check notifications. Afrikapp reserves the right to suspend or terminate accounts that violate these terms.

Payments held securely

Payments for jobs on Afrikapp are made in milestones. Clients are required to make milestone payments once a contract is created. Funds will be held securely until the client approves the completed milestone. Afrikapp will release the funds to the freelancer upon approval. Clients can also make payments offline only via the Afrikapp platform. Afrikapp is not responsible for any payments made outside of the platform. Client will only pay charged the exact amount they see on the platform. Afrikapp will not charge any additional fees to the client. Service fees are paid by the freelancer. Afrikapp reserves the right to change its service fees at any time. In the event of a dispute, Afrikapp will mediate and make a final decision on the distribution of funds. Afrikapp is not responsible for any chargebacks. A fee of 10% will be charged on every milestone the freelancer completes. If a job was earn via an affiliate link, the affiliate will be paid 7% of the total amount earned by the freelancer.

Communication

All communication between clients and freelancers should be conducted through Afrikapp's messaging system. This ensures that all interactions are documented and can be referenced for future clarifications. Afrikapp is not responsible for any agreements or communications made outside of the platform. Clients and freelancers agree to keep all communication on the platform and not share personal contact information. Afrikapp reserves the right to suspend or terminate accounts that violate these terms. Afrikapp may monitor and review messages to ensure compliance with our terms. Afrikapp will not disclose the content of messages unless required by law. Afrikapp continues to monitor all reported Clients and Freelancers to ensure compliance with our terms.

Dispute Resolution

If a contract has been marked has completed by the client and there is a dispute between the client and the freelancer, a refund may not be requested. In case of a dispute between a client and a freelancer, Afrikapp will attempt to help resolve the issue. Afrikapp's decision on the dispute will be final and binding. Afrikapp reserves the right to suspend or terminate accounts that violate these terms.

User Conduct

Users agree to use Afrikapp in a lawful and respectful manner. Prohibited conduct includes, but is not limited to, harassment, discrimination, spamming, and any form of illegal activity. Afrikapp reserves the right to suspend or terminate accounts that violate these terms. Users are responsible for their actions and interactions on the platform. Afrikapp is not responsible for any disputes or damages that may arise from using the platform. Users are encouraged to report any violations of these terms to Afrikapp.

Termination

Afrikapp reserves the right to terminate or suspend your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the platform will immediately cease. If a user wishes to terminate their account, they can do so by contacting Afrikapp support. Afrikapp will review the request and take appropriate action. Afrikapp is not responsible for any damages or losses that may be incurred as a result of account termination. Users are encouraged to back up any important data before terminating their account. Afrikapp may retain user data for a period of time after account termination for legal and administrative purposes. Afrikapp will not share user data with third parties unless required by law. Afrikapp may use user data for internal purposes, such as analytics and product improvement. Users can request the deletion of their data by contacting Afrikapp support.

Limitation of Liability

Afrikapp will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform. Our total liability to you for any claims arising from the use of the platform is limited to the amount you paid, if any, to use the platform Users are encouraged to use the platform at their own risk and to exercise caution when interacting with others. Afrikapp is not responsible for any disputes or damages that may arise from using the platform. Users are encouraged to report any violations of these terms to Afrikapp.

Changes to Terms

Afrikapp reserves the right to modify these terms at any time. We will notify you of any changes by posting the new terms on our website. Your continued use of the platform after any such changes constitutes your acceptance of the new terms. If you do not agree to any of these terms or any future terms, do not use or access (or continue to access) the platform. It is your responsibility to check the terms regularly for any changes.

Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Afrikapp operates, without regard to its conflict of law principles. You agree to submit to the personal and exclusive jurisdiction of the courts located within the jurisdiction in which Afrikapp operates. The failure of Afrikapp to exercise or enforce any right or provision of these terms shall not constitute a waiver of such right or provision. If any provision of these terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of these terms remain in full force and effect. These terms constitute the entire agreement between you and Afrikapp and govern your use of the platform, superseding any prior agreements between you and Afrikapp.
